Many people write in ChatGPT like a diary — personal, late-night, "I'll delete it later."
⚖️So here's the thing: legally, correspondence with AI = ordinary electronic data. Like call logs or card transactions. No secrecy of correspondence, no privilege like with a lawyer. Upon a court request, they will retrieve and read it aloud — along with pictures and questions like "why am I like this." Prosecutors have taken a liking to this; CNN calls chat logs a "gold mine." There have already been several cases:
🔥 Palisades, 2025. A guy is charged with arson in the Los Angeles area. The evidence includes his prompts to ChatGPT about a burning forest.
🔪 Murder, Florida. The suspect was confronted with his queries: "what happens if you put a body in a trash bag and throw it in the dumpster" and "how would they find out later."
👻 Virginia, 2024. Evidence — correspondence with the My AI bot on Snapchat. Result: 25 years.
And "delete chat" in the interface ≠ erased from servers — the provider stores and hands it over.
Conclusion without paranoia: cloud AI is correspondence with a company that can be compelled to hand over everything. Sensitive data (client data, personal info) — use a local model on your own hardware (Ollama and its ilk) or not at all.
